Refund Policy for ViralGrow

This Refund Policy explains how refunds work for paid subscriptions to ViralGrow (https://viralgrow.ai, the "Service"). Payments are processed by Polar (https://polar.sh), our merchant of record.

ViralGrow is a digital service: AI-generated content is produced and delivered to you on demand, and platform features are made available to you continuously throughout your billing period.

1. 14-Day Satisfaction Refund

If you are not satisfied with the Service, you may request a refund of your most recent subscription payment within 14 days of that payment. This applies to both monthly and annual plans.

Because the Service begins immediately and consumes resources on each use, refunds in this window are calculated as follows:
- We deduct a proportionate amount for the period during which the Service was available to you (pro-rata for the days elapsed since the charge); and
- We deduct the value of any credits already consumed by AI generations during the current billing period.

In practice, if you request a refund within 14 days and have made little or no use of the Service, your refund will be all or nearly all of your payment. The more of the period and credits you have used, the smaller the remaining refund.

We may decline a refund where more than 50% of the plan's credit allowance for the current billing period has been used, except where the Service was demonstrably unable to perform its core function.

2. How to Request a Refund

Email us at sam@viralgrow.ai with:
- The email address on your ViralGrow account
- The date of the charge
- A brief reason for the refund (this helps us improve the product)

We aim to respond within 2 business days. Approved refunds are issued by Polar back to the original payment method. Bank processing time is typically 5-10 business days after the refund is issued.

3. Cancellation vs. Refund

Cancellation and refund are different:
- Cancelling your subscription (from your dashboard) stops future renewals but does not by itself refund the current period. You keep access through the end of the period you have already paid for.
- A refund returns money for a charge already made, subject to the conditions in this policy.

You can do either or both. To avoid being charged for the next period, cancel at least 24 hours before the renewal date.

4. Annual Plans

Annual plans are billed for a full year up front at a discounted rate.

- Within 14 days of the initial annual charge, you may request a refund, calculated on the pro-rata plus consumed-credits basis described in Section 1.
- After the 14-day window, annual subscriptions are non-refundable for the remainder of the term. You may cancel at any time to prevent the next annual renewal, and you keep access until the end of the paid term.

5. Non-Refundable Items

The following are not refundable:
- Credits already consumed by AI generations
- The proportionate value of the period during which the Service was available to you
- Charges where fraud, abuse, or violation of our Terms of Service has occurred
- Charges outside the applicable refund window described above, except where required by applicable consumer protection law
- Third-party payment processing fees, where deduction is permitted by applicable law

6. EU/EEA and UK Consumers — Right of Withdrawal

If you are a consumer in the EU, EEA, or UK, you have a statutory right to withdraw from a distance contract within 14 days, without giving a reason.

By purchasing a subscription and beginning to use the Service, you expressly request that the Service begin immediately and you acknowledge that:
- If you withdraw within the 14-day period, you must pay for the portion of the Service already supplied up to the moment you withdraw (calculated pro-rata); and
- Your right of withdrawal is lost once the Service has been fully performed.

This statutory right applies in addition to, and is not limited by, the rest of this policy.

7. Chargebacks

If you believe a charge is incorrect, please contact us first at sam@viralgrow.ai — we will work to resolve the issue quickly. Initiating a chargeback through your bank or card issuer without first contacting us may result in your account being suspended pending resolution.

8. Polar Discretionary Refunds

In addition to this policy, Polar (our merchant of record) may, at its sole discretion, issue refunds in cases of payment disputes or risk-related decisions. Polar's own buyer terms apply to your purchase.

9. Applicable Consumer Protection Law

Nothing in this policy limits any rights you may have under applicable consumer protection law in your jurisdiction (e.g., the EU Consumer Rights Directive, the U.S. Restore Online Shoppers' Confidence Act). If your local law provides stronger refund rights, those rights apply.
