Terms of Service for ViralGrow

ViralGrow is owned and operated by Samuel Yost ("we," "us," or "our"). By accessing or using our platform at https://viralgrow.ai (the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

1. Description of Service

ViralGrow is an AI-powered content generation and scheduling platform for short-form video (TikTok, Instagram Reels, and YouTube Shorts). The Service generates slideshows and reaction videos based on product descriptions provided by users, and can schedule and publish this content to the user's own connected social accounts through the platforms' official APIs.

2. Account Registration

- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the security of your account credentials
- You must be at least 16 years old to use the Service
- One person or entity per account unless otherwise agreed

3. Connected Social Accounts

- By connecting your TikTok, Instagram, or YouTube account, you authorize ViralGrow to schedule and publish approved content to those accounts via the platforms' official APIs
- You are responsible for all content posted through the Service, and you must own or have explicit authorization to publish to each connected account
- You must comply with each platform's Terms of Service and Community Guidelines (TikTok, Instagram, YouTube) when using ViralGrow
- You can disconnect any connected account at any time from your dashboard

4. Content and Intellectual Property

- You retain ownership of all product descriptions, images, and other materials you provide to the Service
- AI-generated content (slideshows, videos, captions) created by the Service is licensed to you for use on your connected social accounts and other marketing purposes
- You are responsible for ensuring that content posted through the Service does not infringe on third-party rights
- We do not claim ownership of content generated for you

5. Acceptable Use

You agree not to:
- Use the Service to post spam, misleading, defamatory, or harmful content
- Violate the Terms of Service or Community Guidelines of any connected platform
- Use the Service to circumvent platform restrictions, rate limits, or content policies
- Post to accounts you do not own or do not have explicit authorization to manage
- Attempt to reverse-engineer the Service
- Use the Service for any illegal purpose
- Share your account access with unauthorized third parties
- Exceed the credit allowance of your subscription plan

6. Subscriptions, Payments, and Auto-Renewal

- The Service offers paid subscription plans with different feature tiers and monthly credit allowances. Plans are available with monthly or annual billing.
- Payments are processed by Polar (https://polar.sh), our merchant of record. Polar is the seller of record and collects payment on our behalf. Your contractual relationship for billing is with Polar.
- Subscriptions renew automatically at the price displayed on /pricing at the time of purchase. Monthly plans renew each month; annual plans renew each year. You will continue to be charged on the renewal date until you cancel.
- You can cancel at any time from your dashboard. Cancellation stops future renewals; you retain access through the end of your current billing period.
- Refunds are governed by our Refund Policy (available at /refund-policy).
- We may change pricing for new customers at any time. Existing subscribers will be given at least 30 days notice before any price increase takes effect on their plan.

7. AI-Generated Content Disclaimer

- Content generated by AI may not always be perfect or suitable for your needs
- You should review AI-generated content before publishing
- We do not guarantee specific results, engagement, views, followers, or revenue from content created or posted through the Service
- AI models, prompts, and content quality may change and improve over time

8. Service Availability

- We strive to maintain high availability but do not guarantee uninterrupted access
- We may perform maintenance or updates that temporarily affect the Service
- We are not liable for any losses resulting from Service downtime, third-party API outages, or platform policy changes

9. Limitation of Liability

To the maximum extent permitted by law, ViralGrow shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, accounts, or business opportunities arising from your use of the Service.

10. Termination

- You may cancel your account at any time from your dashboard settings
- We may suspend or terminate your account if you violate these Terms or the Acceptable Use Policy of Polar (our merchant of record)
- Upon termination, your data will be deleted in accordance with our Privacy Policy

11. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the Netherlands. Any disputes shall be resolved in the courts of the Netherlands. Where applicable, U.S. federal and state consumer protection laws (including the Restore Online Shoppers' Confidence Act) and EU consumer protection laws apply to residents of those jurisdictions.
